style="padding-left: 30px;">Far as I’m concerned, it’s safe to assume that <em>every</em> hominid  wearing a <a
href="http://www.nostate.com/37/the-clown-suit-defense-and-the-excuses-of-symbols/">police uniform</a>, badge, weaponry, restraint tools and comms  devices is a robber <em>at least</em> under a natural law theory of  justice (that is to say, show me even <em>one</em> who hasn’t written  someone a ticket for a non-rights-violating traffic “violation” and I’ll  withdraw my “every” claim). If that is granted, then all cops are  outlaws. Outlaws have no legitimate claim to protection by the members  of a free society and, therefore, I would support the actions of anyone  discriminating against cops for any reason whatsoever and <em>as  violently as possible</em>, up to and including, but not limited to,  shooting them in the face on sight.</p><p

/> [6:48] Mike: another way to look at the first question is &#8220;Is there any way to have a state which doesn&#8217;t fail at its primary mission of protecting people and property? Is there a way to constitute a state so that it simply can&#8217;t be evil?&#8221;<br

/> [6:50] Mike: now, in case 1, everyone&#8217;s a saint&#8230; why should a state even be necessary in such case?<br

/> [6:50] Mike: and, since we know that 1 isn&#8217;t true, we can discount it anyway<br
/> [6:50] Jana: There&#8217;s 5: about the same number of people are good as there are bad<br
/> [6:50] Mike: fine, can be, but 3 and 4 turn out to be equivalent propositions anyway<br
/> [6:51] Mike: and the statistical probability of that is miniscule, assuming a mix of &#8220;good&#8221; and &#8220;evil&#8221; human natures, against present world population<br
/> [6:51] Mike: so case 1 is out, because if everyone were saints, there would be no need of a state for crime prevention/investigation/punishment &#8212; there would be no crime<br

/> [6:52] Mike: now for case 2. if all of us are evil, then will not the MOST evil people try to obtain control of the state, so that they can use its power to aggrandize themselves?<br

/> [6:53] Mike: seems a bit like giving a blank check to those who&#8217;d screw us, even though we might do the same in their position, being as we&#8217;re evil and all<br
/> [6:53] Mike: remember now that being PART OF the state means that you can do things which are disallowed to ordinary citizens<br
/> [6:54] Mike: like: if a police car has a hundred kilos of cocaine in the trunk, the presumption is that it&#8217;s evidence, and that&#8217;s okay.<br

/> [6:54] Mike: but if you had a hundred kilos of blow in your trunk, you&#8217;re a criminal, because you don&#8217;t have a fancy uniform, etc.<br

/> [6:54] Mike: so, even a society comprised entirely of evil people ought to recognize that having a state is too dangerous<br
/> [6:55] Mike: now, unless we&#8217;re going to include ourselves in &#8220;everyone is evil&#8221;, #2 doesn&#8217;t really operate anyway<br
/> [6:55] Mike: I don&#8217;t feel particularly evil<br
/> [6:55] Mike: and I doubt you are either<br

/> [6:55] Mike: so we are left with the two mixes<br

/> [6:56] Mike: in case number 4, more people are evil than are good<br
/> [6:57] Mike: well, unless we want evil to triumph here by sheer force of numbers, certainly the GOOD people in that world don&#8217;t want the state, because it&#8217;s bound to be comprised of a majority of evil people with uniforms and official documents &#8212; even forgetting that evil people will TEND to try to become part of the state, so that they can commit crimes with official permission<br

/> [7:11] Mike: if you believe, as I do, that taxation is theft, and therefore no more honorable than a robbery in the street, and that the killings done by soldiers and police in uniforms are generally murders, then you realize there&#8217;s a whole shitload of crime out there that is legally defined otherwise.<br

/> [7:12] Mike: so by simply getting rid of the state and the privilege that attaches to states&#8217; agents, a huge amount of evil acts are prohibited straight off<br
/> [7:12] Mike: in addition to this, there are HUGE numbers of peaceful acts which are defined by states to be crimes, even though they really aren&#8217;t<br
/> [7:12] Mike: the cocaine in the car, for example<br
/> [7:12] Mike: no victim, no crime<br
/> [7:13] Mike: failing to pay taxes leads to being classed as a criminal<br
/> [7:13] Mike: operating a business without a license<br
/> [7:13] Mike: immigrating without state permission<br
/> [7:13] Mike: and on and on<br

/> [7:14] Mike: real crimes, the ones that all of us rightly fear and wish to eliminate, are those which violate the life, liberty or property of one or more other persons<br
/> [7:14] Mike: one cannot commit a crime against oneself, by definition (despite this, suicide is illegal in many places)<br
/> [7:14] Jana: Illegal?<br
/> [7:15] Mike: so, once again by getting rid of the state, we see that a huge part of the &#8220;crime problem&#8221; simply evaporates<br
/> [7:15] Jana: So if you kill yourself, you can be charged, too?<br
/> [7:15] Jana: Yes, a huge part, but the part we really care about doesn&#8217;t.<br
/> [7:15] Mike: well, some people who have attempted suicide have been charged, yes&#8230; doesn&#8217;t happen often, but the laws are on the books in places<br
/> [7:16] Jana: The real crimes that violate the life, liberty and property.<br
/> [7:16] Jana: Crazy, man.<br
/> [7:16] Mike: right: murder, theft, arson, extortion, rape, kidnapping, enslavement, etc.<br

/> [7:18] Mike: now let&#8217;s think a bit about what&#8217;s usually called &#8220;justice&#8221;<br
/> [7:18] Mike: if someone comes and robs you of your money, or burns down your flat, or kills your dog, what benefit is it to YOU if that person is caged in a concrete and steel box for a period of years as a punishment?<br
/> [7:19] Jana: I don&#8217;t know. I&#8217;d rather get my money or my flat back. Or kill him back for killing my dog.<br
/> [7:20] Mike: now you&#8217;re onto something<br
/> [7:20] Mike: you&#8217;d like to have your situation restored to be at least as good as it was prior to the crime<br
/> [7:20] Jana: Exactly.<br
/> [7:20] Mike: you&#8217;d also probably like to be compensated to some degree for the bother and hassle of having to go through that<br
/> [7:20] Jana: And maybe get some cash as compensation for my trouble.<br

/> [7:20] Mike: punitive damages or something, right<br
/> [7:21] Mike: now, in the law, when we get to acts like these, we find there is a big difference in how those cases go to the courts, versus the cases like, say, your tree fell on my house and I want you to pay damages<br
/> [7:21] Mike: those are &#8220;civil&#8221; cases, where it&#8217;s &#8220;Mr. White vs. Mr. Green&#8221; in the court documents.<br
/> [7:21] Jana: Right.<br
/> [7:22] Mike: alleged victim and alleged perpetrator come to court, and in theory the process should determine if a harm (a &#8220;tort&#8221;, in the legal language) occurred, and if so, how the victim of that tort can be made whole again<br
/> [7:23] Mike: if, instead of Mr. Green&#8217;s tree falling on Mr. White&#8217;s house, Mr. Green goes and burns Mr. White&#8217;s house to the ground, the court documents are not going to be able &#8220;White v. Green&#8221;<br
/> [7:23] Mike: they will be &#8220;THE STATE v. Green&#8221;<br
/> [7:24] Jana: Because Mr. White burned to death?<br
/> [7:24] Mike: Mr. White was away on holiday in this case<br
/> [7:24] Jana: Oh, good.<br
/> [7:24] Mike: or escaped, whatever<br
/> [7:24] Mike: yes, lucky for Mr. White, eh? <img

/> [7:25] Mike: and some prosecuting lawyers get on the case and work to prove that Mr. Green is guilty of the crime of arson, and if so, how long he should spend in prison for that.<br
/> [7:25] Mike: the interests of the real victim, here, Mr. White, are largely pushed to the side.<br

/> [7:26] Mike: the fact that Mr. White was threatened or inconvenienced by Green&#8217;s action is not really under consideration. What must be proven is that Mr. Green *broke the law*<br
/> [7:26] Jana: Well, great.<br
/> [7:26] Mike: all kinds of problems, here<br
/> [7:28] Mike: among other things, it means that the victim&#8217;s interests are not really being represented in the search for &#8220;justice&#8221;<br
/> [7:28] Mike: in terms of penalties, what the state seeks is punishment of the criminal (in order to deter others from committing crimes), rather than recompense for the victim(s)<br
/> [7:29] Jana: Well, this side effect of the punishment is actually quite welcome.<br
/> [7:29] Mike: deterrence is necessary, sure<br
/> [7:29] Mike: what Mr. White really wants here is a new house and some money to compensate his inconvenience and stress<br
/> [7:30] Mike: that money ought to come from Mr. Green, or, perhaps, from some sort of insurance that Mr. White purchased against such an eventuality.<br
/> [7:30] Mike: what we get into next is a topic that has been done at book-length by several authors<br

/> [7:31] Mike: assumption: there&#8217;s no state, but there&#8217;s still some crime<br

href="http://www.canada.com/vancouversun/news/westcoastnews/story.html?id=79109524-50ad-4bfd-bc17-7c2edfda7aae">From the Vancouver Sun</a>:</p><blockquote><h3>Victoria must pay tethered teen $30,000</h3><p>Friday, November 28, 2008</p><p>VICTORIA &#8211; Willow Kinloch has been granted half of the $60,000 she won in a lawsuit after being tethered in Victoria police cells, with the payment of the rest hinging on an appeal of her case by the City of Victoria.</p><p>The city had applied for a stay, or suspension, of payment until the appeal is heard, perhaps sometime next spring. But Justice Mary Saunders of the B.C. Court of Appeal ruled Thursday that Kinloch is entitled to $30,000 now.</p><p>Kinloch&#8217;s case dates to 2005 when she was 15. A B.C. Supreme Court jury came up with the award earlier this year following a decision that officers had violated Kinloch&#8217;s charter rights.</p><p>Kinloch had been picked up by police in the downtown area for being drunk and was taken to police cells.</p><p>She spent about an hour screaming and banging on the walls before two officers tried to take her home to the apartment she shared with her mother.</p><p>The apartment intercom was broken and officers wouldn&#8217;t let Kinloch yell up to a window, so she was brought back to the police station. She did not want to return to a cell, and police described her as uncooperative. She ended up being bound at the ankles, tethered and left in the cell for four hours.</p><p>Kinloch is now in Thailand.</p></blockquote><p>Here&#8217;s to hoping Ms. Kinloch is safe, given the unrest in Thailand at the moment.</p><p>See also:<br

name="src" value="http://www.youtube.com/v/TQZoir3Lygo&amp;hl=en" /></object></p><p>Text of the speech, from Adam Kokesh&#8217;s blog:</p><p>When I joined the Marines at a little strip mall in Santa Fe, and when I was in boot camp in San Diego, and when I was dodging mortars in Fallujah, I could not have imagined that I would one day share a stage with such renowned speakers. However, to march shoulder to shoulder, and to stand in solidarity with you, is a far greater honor.</p><p>It has been said that when in the course of human events, an oppression so revolts its subjects, it becomes necessary to alter or abolish the means of that tyranny. Is it that time when our Bill of Rights is defiled every day? When our adventures abroad threaten our security at home? When the Federal Reserve keeps our free nation enslaved by debt? When the people of the world tremble under the thumb of corporate imperialism? And now our nation is drifting dangerously from freedom to fascism. So I have to ask, is it time? The time is now, the threat is clear, the bands of tyranny are tightening around America, and it is our duty to resist!</p><p>As empowered patriots, let us take stock of our commitment to the ideals upon which this country is founded. America without her freedoms is like a body without a soul. The challenge before the Freedom Movement is no less, than to bring about a revolution of values, inspire a renaissance of American politics, and breathe new life into the tortured body of our nation. We will meet that challenge with courage and love, and as always, we the people, will prevail!</p><p>To rally the troops of the Revolutionary Army in the winter of 1776, Thomas Paine said, “These are the times that try men&#8217;s souls. The summer soldier and the sunshine patriot, will in this crisis, shrink from the service of their country; but he that stands by it now, deserves the love and thanks of man and woman. Tyranny, like hell, is not easily conquered.”</p><p>As Iraq Veterans Against the War, we are resisting an occupation that we once risked our lives for. We swore to support and defend the Constitution of the United States of America, but we found out the hard way that the greatest enemies of the Constitution are not to be found in the sands of some far off land, but rather right here at home! We are your new winter soldiers and we are still defending America.</p><p>We bring the values, skills, and commitment that make us warriors to the fight before us today. We are working to end the war by strategically withdrawing our material support and inspiring others to do the same. By advocating for veterans, we honor those who served, and empower soldiers to become successful civilians. With Truth In Recruiting, we are inspiring a generation of young Americans to find a better way to serve this country than dying for empire. By supporting those who are actively resisting, we inspire further resistance, and ensure that soldiers still have the right, as is their duty, to disobey illegal orders.</p><p>During the siege of Fallujah, a young Lance Corporal was shot through the side of his flak jacket in a firefight to the west of the city. The bullet hit an artery near his spine. My team was called to help get him to the field hospital at Camp Taqadum. He was on a stretcher in the humvee in front of me, and I watched the Corpsman treating the external wound in a frightened, hurried panic, as the dust from the hot road swirled around us. When we got there, I carried him in as he moaned and writhed in pain, barely conscious. He flailed his arm off the stretcher, and as I put it back by his side I told him, “Don&#8217;t worry. You made it. You&#8217;re gonna be OK.” But he died only minutes later from the internal bleeding.</p><p>I have to live with that memory every day, but I have learned from it. I will not tell you that the band-aids applied by Republicans and Democrats will heal us. I will not pretend that everything is just going to be ok while we are bled dry by tyrants. And if it takes the last full measure of devotion, I will not allow the same fate to befall this country!</p><p>This young movement, is getting past the external wounds to the greater evils plaguing this nation. We know, that the greatest threat to American security is the current corruption of our government! No politician has ever ended a war. Civil rights were won in this country not by any legislator, but by a movement. I have great hope for America, but not because of an election. No, my hope comes from you!</p><p>Our tragic love affair with the state, has led us to put far too much trust in a government that we hoped could improve our lives, but has instead come to run our lives for us. We have become, as a people, like a frightened, battered, beat down victim of an abusive relationship. A servile, unquestioning, obedient people, will always produce tyrants. We must, as a nation, once again, embrace defiance, rebellion, and resistance!</p><p>Every day more and more Americans are avoiding unenforceable taxes, leaving government jobs out of disgust, and sending their kids to college instead of combat. But our efforts as a movement must become unified and deliberate to fully withdraw our compliance and support. Be it with your lives, labor, or tax dollars, stop investing in your own oppression! Guard your communities from the police state! Do not waste a single vote, or a single dollar, on the two-party system! Do not be content merely to grumble and to march while they are using fear, force, and violence as weapons of oppression. We must embrace the opportunity to resist civilly while we still can!</p><p>We are compelled to be here for many different reasons, and there is strength in our diversity. As within Iraq Veterans Against the War and Veterans For Peace, we do not need to be uniform to be unified. Take a look at the thoughtful, passionate people around you on this field, and throughout this country. Do not leave here without meeting a new brother or sister in the struggle. Take with you the inspiration to share your passion with someone who does not know they are yet part of our movement. Seek out where you can be most effective in the cause of liberty.</p><p>Challenge our force fed culture of unquestioning conformity and compliance. Embrace a world that is not defined by the politics of fear, our obedience producing schools, or the false prophets of the corporate media. As we have been awakened, we must stir the sleeping masses. As the forces of oppression are diligent, so must we toil. As they are committed, we must surpass them. As they step up their efforts, we must rise up to defeat them as a unified movement!</p><p>We have been labeled rebels, traitors, enemies of the state. All terms King George would have used to vilify our founders. I, for one, will always rebel against oppression, a traitor only to tyranny, and I would be remiss to not be the enemy of a state, that so blatantly tramples our freedoms.</p><p>American values have been nearly vanquished by consumerism, militarism, and authoritarianism. Yellow ribbons and lapel pins will not save this country. When injustice becomes law, resistance becomes duty. The utmost manifestation of love and devotion to America, is today as it always has been, resistance of tyranny! Resist we must, and resist we will! We will not be silent! We will not obey! We will not let our government destroy our humanity! We will not wait another moment in fear to stand up for what we know to be right! It is time the government starts fearing the people again! It is time that we meet oppression with resistance!</p><p>They cannot stop us! Humanity marches on. You can fight it, or fight for it. When we say revolution, we say it with love. As we march onward from this place where we have pledged to each other our lives, our fortunes, and our sacred honor, let us embrace the struggle, cherish the fight, and live in that love. The passion of our hearts will be raised with our fists!</p> <br
